Legal

Terms of Service

These Terms govern your access to and use of the BoolRider mobile application, website, and all related services. Please read them carefully before using BoolRider.

These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "your") and BoolRider LLC ("BoolRider," "we," "us," or "our"), an Illinois limited liability company. These Terms govern your access to and use of the BoolRider mobile application, website (www.boolrider.com), and all related services (collectively, the "Service").

By creating an account, accessing, or using BoolRider, you agree to be bound by these Terms, our Privacy Policy, and our Cancellation Policy, all of which are incorporated by reference. If you do not agree to these Terms, do not use the Service.

PLEASE READ SECTION 15 (ARBITRATION AND CLASS ACTION WAIVER) CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT, AND LIMITS THE MANNER IN WHICH YOU MAY SEEK RELIEF.

1. The BoolRider Platform

BoolRider is a technology platform that facilitates cost-shared ridesharing arrangements among verified college students. Drivers who are already planning a trip post their route and available seats; riders browse posted trips and request to join. BoolRider does not accept or fulfill rider-initiated transportation requests to custom destinations.

BoolRider is a technology and matching service, not a transportation provider. We do not own, operate, or control any vehicles. We do not employ, contract, or supervise drivers. We do not provide, arrange, or guarantee transportation. Drivers are independent users of the platform who are making trips for their own purposes and voluntarily sharing available seats. All ridesharing arrangements facilitated through BoolRider are private, voluntary cost-sharing arrangements between individual users. BoolRider's role is limited to providing the software service that enables users to discover compatible trips, communicate, and share the cost of travel.

2. Eligibility

To use BoolRider, you must:

  • Be at least 18 years of age.
  • Be currently enrolled at an accredited college or university in the United States and possess a valid .edu email address.
  • Be legally capable of entering into a binding contract.
  • Not have been previously suspended or removed from the Service.

By creating an account, you represent and warrant that you meet all eligibility requirements. BoolRider reserves the right to verify your eligibility at any time and to suspend or terminate your account if you do not meet these requirements.

3. Account Registration and Security

To use BoolRider, you must create an account using a valid .edu email address. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify BoolRider immediately at privacy@boolrider.com if you become aware of any unauthorized use of your account.

You may not share your account with anyone else, create more than one account, or create an account on behalf of another person. BoolRider may suspend or terminate any account that we reasonably believe is being used in violation of these Terms.

4. Identity Verification

BoolRider verifies your identity through two mechanisms:

  • Email verification: You must confirm ownership of a valid .edu email address.
  • Government ID verification and live facial verification (drivers only): If you wish to offer rides as a driver, you must submit a government-issued identification document through our payment processor, Stripe. As part of this process, you will be required to complete a live facial verification, which confirms that you are the person depicted on the identification document you submit. Both the ID verification and facial verification are performed entirely by Stripe. BoolRider does not receive, access, or store your identity documents or facial verification data. For more information about how Stripe handles your biometric information, please review Stripe's privacy policy at stripe.com/privacy.

The live facial verification works by comparing a photo of your face to the photo on your license, which produces a scan of your facial geometry. BoolRider does not perform that scan and does not store it — Stripe does both. We will show you a separate consent notice and obtain your agreement before any such verification can begin; verification cannot start without it. See Section 3.5 of our Privacy Policy for the full explanation, including how long Stripe keeps the data and how it is destroyed.

Failure to complete identity verification may limit your ability to use certain features of the Service. Identity verification gates the posting of rides; it is not required to browse, request, or take a ride.

5. Driver Requirements and Responsibilities

To offer rides on BoolRider, you must, in addition to meeting the general eligibility requirements in Section 2:

  • Hold a valid driver's license issued by a U.S. state or territory.
  • Use a vehicle that is currently and validly registered and legal to operate. The vehicle need not be registered in your name; if it is not, you represent and warrant that you have the registered owner's permission to operate it for the purpose of providing rides through BoolRider.
  • Be covered under a valid automobile insurance policy for the vehicle you use — whether the policy is your own or one under which you are a covered driver (for example, a policy held by a parent) — that meets or exceeds the minimum coverage required by the state in which you operate, and provide proof of such insurance to BoolRider.
  • Scope of BoolRider's insurance review: BoolRider reviews submitted insurance documentation only to confirm that a current policy exists for the vehicle. BoolRider does not verify that you are a covered or named driver under the policy, and does not verify that the policy permits carrying passengers in a cost-shared ridesharing arrangement. Sole responsibility for confirming both rests with you, and you represent and warrant that you have confirmed with the applicable insurer that your use of the vehicle on BoolRider is covered.
  • Provide accurate information about your vehicle, including make, model, color, and license plate number. License plate numbers are collected to support safety and incident reporting, and are masked in the app interface as described in our Privacy Policy.
  • Provide a payout destination — a Venmo username or a Zelle handle — so that we can send you the cost contributions you earn.

5.1 What Must Be In Place Before You Can Post

Posting a ride requires all three of the following. None of them is required to browse, request, or take a ride as a passenger:

  • A verified driver's license, through the Stripe identity check described in Section 4.
  • A verified proof of insurance, within the review scope stated in Section 5. You upload a photo or PDF of your insurance card or policy declaration, and a member of the BoolRider operations team reviews it by hand. Review is not instant. We will tell you if a document is rejected and why, and you may submit a replacement. From the document we record your insurer, the policyholder's name, and the policy expiration date, and we will remind you before the policy expires.
  • A payout destination on file. You can add or change this yourself at any time in Account.

We may request updated documentation at any time, and we may withdraw a verification we previously granted — for example if a policy expires or a document turns out to be inaccurate. If any of the three lapses, you keep full access to the Service as a rider, but you will not be able to post new rides until it is restored.

You are responsible for keeping your insurance current. A verification granted by BoolRider is a check that you supplied a document, not a guarantee of coverage, and it does not make BoolRider a party to or a guarantor of your insurance policy.

As a driver, you represent and warrant that:

  • You are posting trips that you are already planning to take for your own purposes. You are sharing available seats with other students, not providing transportation as a commercial service.
  • Your driver's license has not been suspended or revoked.
  • Your vehicle is in safe operating condition and passes all applicable state inspection requirements.
  • You will comply with all applicable traffic laws, regulations, and ordinances while operating your vehicle.
  • You will not operate your vehicle while under the influence of alcohol, drugs, or any substance that impairs your ability to drive safely.
  • You understand that the cost contribution you receive from riders is reimbursement for your vehicle operating expenses (fuel, wear, and mileage) on a nonprofit basis, and does not constitute payment for a transportation service.
  • You understand and accept that the automobile insurance policy covering the vehicle you use is the primary coverage for any incident that occurs during a ride. Because BoolRider facilitates cost-shared ridesharing arrangements — not commercial transportation — that policy should generally apply. However, BoolRider makes no representations about your insurance coverage and strongly recommends that you confirm with your insurer that your policy covers carrying passengers in a cost-shared ridesharing arrangement. BoolRider does not provide automobile insurance, supplemental coverage, or any form of liability coverage for rides facilitated through the platform.
  • You are solely responsible for any traffic violations, parking tickets, tolls, accidents, injuries, or property damage that occur in connection with any ride.

BoolRider reserves the right to request updated documentation at any time and to suspend or remove drivers who fail to maintain these requirements.

6. Rider Responsibilities

As a rider, you agree that:

  • You will be present at the agreed-upon pickup location at the agreed-upon time.
  • You will treat the driver and their vehicle with respect. You are responsible for any damage you or your belongings cause to a driver's vehicle.
  • You will wear a seatbelt at all times during the ride.
  • You will not bring illegal substances, weapons, or hazardous materials into any vehicle.
  • You will not ask or encourage a driver to violate traffic laws or drive unsafely.
  • You acknowledge that ridesharing arrangements are between you and the driver. BoolRider provides the technology to discover and coordinate these arrangements but does not provide transportation and makes no representations or warranties about the safety, reliability, or quality of any ride or driver.

7. Trip Listings, Bookings, and Cost Sharing

7.1 Trip Listings

Drivers post trips they are already planning to take, specifying origin, destination, departure window, available seats, and any applicable preferences or notes. Only drivers may create trip listings. BoolRider does not accept rider-initiated requests for transportation to custom destinations; riders may only browse and join trips that drivers have independently posted.

7.2 Cost-Sharing Price Cap

The cost contribution charged to riders is limited to reimbursement of the driver's vehicle operating expenses, shared proportionally among all occupants of the vehicle (including the driver). BoolRider calculates the maximum per-seat cost contribution using the following formula:

Maximum per-seat price = (trip distance in miles × IRS standard mileage rate) ÷ total occupants (driver + riders)

The IRS standard mileage rate is updated annually. As of January 1, 2026, the rate is $0.725 per mile. Drivers may set their cost contribution at or below the calculated maximum but may not exceed it. This cap ensures that drivers receive reimbursement for operating expenses only and do not profit from providing rides.

7.3 BoolRider Service Fee

BoolRider charges the rider a service fee for providing the technology platform that enables users to discover, coordinate, and transact ridesharing arrangements. This fee is compensation for BoolRider's matching, communication, and payment processing services — it is not a fee for transportation, and it is not part of the cost-sharing contribution capped by Section 7.2.

The fee is charged to the rider on top of the driver's posted price. It is calculated as a percentage of that price plus a small flat amount, subject to a minimum. The exact amount is always itemized for the rider — shown as a separate "Service fee" line alongside the ride price and the total — before the rider submits a request, and it is included in the locked quote described in Section 7.5.

The driver receives the price they posted, in full. The service fee is never deducted from the driver's amount and is never shared with the driver.

BoolRider reserves the right to introduce, modify, or waive service fees at any time with reasonable notice to users. A change to the fee never affects a booking that has already been quoted: the fee in force when your quote was issued is the fee you pay.

7.4 Bookings

Riders may request to join an available trip. A booking is not confirmed until the driver accepts the request. Once a driver accepts a booking, both parties are expected to honor the arrangement, subject to the cancellation policy described in Section 8.

A rider may instead ask for a small change to the trip — an extra stop, a different drop-off, or a different departure time — as part of their request. A change request is a seat request with a condition attached, not a separate conversation. If the driver accepts it, it becomes an ordinary confirmed booking on the spot: the seat is claimed, the payment hold is placed for the fare plus the agreed add-on, and the booking proceeds exactly like any other from that point on. There is no second confirmation step and nothing is left agreed-but-unbooked. If the driver declines, the change is declined — and so is the booking, unless the rider had already requested that seat separately, in which case the plain request stands with the add-on removed.

Any price add-on for a change reflects the additional distance the change adds, priced at the same IRS standard mileage rate used in Section 7.2, and remains subject to that section's cap. Negotiation over a change is limited to one offer and one counter-offer; there is no open-ended haggling. A rider whose seat is already confirmed cannot open a change request, because the payment hold for that booking is already locked; they should message the driver instead.

7.5 Quoted Price and Payment Authorization

You are never charged more than the price you last approved. When a rider submits a request, BoolRider locks a quote: the seat price, the service fee, and the total. That quote is calculated by BoolRider's servers, not supplied by anyone's device, and it does not move afterwards. If the driver edits the listing price after the request is submitted, the rider's locked total is unaffected.

If a change would raise the rider's total — for example, an agreed add-on for an extra stop — the rider is issued a revised quote and must approve it. The driver cannot accept the booking until they do, and if the rider declines, nothing is charged.

When a booking is accepted, the rider's payment method is authorized (held) for the approved total — the cost contribution plus the service fee. The charge is not captured until the trip is completed and confirmed.

7.6 No Guarantee of Availability

BoolRider does not guarantee that trips will be available for any particular route, time, or destination. The availability of trips depends entirely on drivers who independently choose to post their planned travel.

8. Cancellation Policy

Our full Cancellation Policy is incorporated into these Terms by reference. This section summarizes it; where the two differ, the Cancellation Policy governs.

Rider cancellations are subject to the following fee schedule, based on how far in advance of the scheduled departure the cancellation is made:

Cancellation WindowFee
More than 24 hours before departureNo fee — full refund of everything you paid, service fee included
6 to 24 hours before departure50% of the ride price
Less than 6 hours before departure75% of the ride price

The percentage is calculated on the driver's ride price, not on the rider's total. The cancellation fee is deducted from the refund issued to the rider and paid to the driver as compensation for the cancelled booking; BoolRider does not keep any part of it.

In the two fee-bearing windows, BoolRider retains the service fee, because the processing cost it covers has already been incurred and is not returned to us when we refund. More than 24 hours before departure there is no fee of any kind: the rider is refunded the entire amount they paid, service fee included, and BoolRider absorbs that cost. BoolRider does not charge a separate cancellation processing fee.

Driver cancellations. If a driver cancels a trip that has at least one confirmed rider, every affected rider is refunded in full, regardless of timing — a driver's cancellation is never the rider's fault. A driver may freely remove a posted trip that nobody has booked. Repeated or late driver cancellations are subject to the escalating consequences set out in the Cancellation Policy, up to suspension or removal from the platform.

Additionally, cancellations made within 12 hours of departure are recorded as late cancellations and may affect the cancelling user's reliability score, which is visible to other users.

No-Shows: If a rider fails to appear at the agreed pickup location and time, or if a driver fails to depart for a confirmed trip, the absent party may be treated as a no-show. No-shows may result in a full charge (for riders) or a full refund (for rider when the driver no-shows), and will negatively impact the absent party's reliability score.

BoolRider reserves the right to modify this cancellation policy with reasonable notice to users. The policy in effect at the time a booking is confirmed will apply to that booking.

9. Payments and Payouts

All rider payments are processed through Stripe. By using BoolRider, you agree to Stripe's terms of service and privacy policy.

Accepted payment methods. Riders pay by credit or debit card, or through a digital wallet such as Apple Pay or Google Pay, using whichever methods Stripe supports at the time. Your card details are entered into Stripe and never reach BoolRider's servers: we keep only the card brand, the last four digits, and the wallet type, so you can recognize the method you saved. Rides cannot be paid for in cash, and a driver may not ask a rider to pay outside the app.

Riders: Your payment method is authorized when a booking is accepted, for the total you approved under Section 7.5. The charge is captured only after the trip is completed. If a trip is cancelled, your payment is refunded in accordance with the cancellation policy in Section 8.

Drivers: To be paid, you must give us a payout destination — a Venmo username or a Zelle handle. You must have one on file before you can post a ride.

BoolRider collects the rider's payment, retains its service fee, and then sends you your share. Payouts are sent manually by BoolRider's operations team from a BoolRider business account to the handle you provided. There is no automated payout integration, and BoolRider never asks for, receives, or stores your bank account number, routing number, or any login credential for Venmo, Zelle, or your bank. We store the handle and nothing more.

When your earnings are released. At the start of the ride the rider gives you a pickup code. After that, both of you get the option to confirm in the chat that the ride happened. What follows depends on who confirms:

What happens after the rideWhen the driver's earnings are released
Both of you confirmImmediately, the moment the second confirmation lands
One of you confirms, the other doesn't24 hours after pickup
Neither of you confirms72 hours after pickup
The rider disputes the rideNothing is released; a BoolRider reviewer looks at it (Section 9, *Refunds and Disputes*)

The clock runs from the moment the pickup code is verified, because that is the last point at which the platform learns anything about the ride. We remind whoever has not confirmed, in the app, at roughly two hours and twenty hours after pickup. If the pickup code was never used, earnings are never released automatically at all — contact us and a person will sort it out.

Release is when the money becomes yours. Payment then goes out to your Venmo or Zelle within 24 hours of release, sent by hand by our operations team. Payouts reflect only the cost-sharing contribution — the price you posted — and never include BoolRider's service fee, which the rider pays separately and which BoolRider retains.

You are responsible for the accuracy of the handle you provide. If you give us a handle that is wrong, that belongs to someone else, or that cannot receive the payment, BoolRider is not responsible for money sent to it in good faith, though we will work with you in good faith to resolve the problem. If you remove your payout destination while money is owed to you, that money remains owed and is sent once you provide a valid destination.

Venmo and Zelle are independent third-party services, and your use of them is governed by their own terms. BoolRider does not control them and is not responsible for their fees, holds, limits, delays, or availability.

Refunds and Disputes: If you believe you were incorrectly charged, contact us at support@boolrider.com. BoolRider will review the transaction and may issue a refund, partial refund, or adjustment at its discretion. If a payment dispute cannot be resolved informally, it will be subject to the arbitration provisions in Section 15.

Chargebacks: If you dispute a BoolRider charge with your bank or card issuer, we receive notice of that dispute and record it. Initiating a chargeback rather than contacting us first may result in your account being restricted or suspended while the dispute is resolved.

BoolRider is not responsible for any fees, interest, or charges imposed by your bank, card issuer, or payment provider in connection with transactions on the platform.

10. User Conduct

BoolRider has zero tolerance for objectionable content and abusive behavior. Content that is abusive, harassing, threatening, hateful, sexually explicit, discriminatory, or that targets another user is not permitted anywhere on the Service — in messages, listings, notes, reviews, profiles, or photos — and accounts that post it are removed. There is no warning quota: a single serious violation is enough.

You agree not to:

  • Use BoolRider for any unlawful purpose or in violation of any applicable law or regulation.
  • Harass, threaten, intimidate, or engage in abusive behavior toward any other user.
  • Discriminate against any user on the basis of race, color, religion, national origin, sex, gender identity, sexual orientation, disability, or any other protected characteristic.
  • Misrepresent your identity, affiliation, or the details of a ride listing or request.
  • Use the platform to transport illegal substances, weapons, or contraband.
  • Attempt to complete ridesharing transactions outside the BoolRider platform to avoid fees or circumvent these Terms.
  • Post a trip listing for a trip you do not genuinely intend to take for your own purposes, or post listings primarily for the purpose of earning money rather than sharing the cost of a trip you are already making.
  • Charge or attempt to charge riders above the cost-sharing cap calculated by BoolRider, or arrange supplemental payments outside the platform to circumvent the price cap.
  • Use automated scripts, bots, or other means to access or interact with the Service.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Collect or harvest personal information about other users without their consent.
  • Post false, misleading, or defamatory reviews or ratings.
  • Create multiple accounts or create a new account after having been suspended or banned.
  • Provide a payout destination that is not yours, or attempt to have another user's earnings sent to you.
  • Post, send, or upload content that is abusive, harassing, threatening, hateful, sexually explicit, or discriminatory, or that shares another person's private information without their consent.
  • Attempt to move a conversation off the platform in order to evade our content rules, or attempt to defeat our content filters.

BoolRider reserves the right to investigate and take appropriate action in response to violations of this section, including removing content, issuing warnings, temporarily restricting your ability to send messages or to post and request rides, suspending accounts, permanently banning users, and reporting conduct to law enforcement where appropriate.

11. User Content

"User Content" means any text, photos, reviews, ratings, messages, or other content you submit, post, or transmit through the Service.

You retain ownership of your User Content. By posting User Content on BoolRider, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, and create derivative works of your User Content in connection with operating, promoting, and improving the Service. This license continues even if you stop using the Service, but only with respect to User Content that was shared with other users or incorporated into the Service before your account was deleted.

You represent and warrant that you own or have the necessary rights to post your User Content and that your User Content does not infringe the intellectual property or other rights of any third party.

BoolRider does not endorse any User Content and is not responsible for the accuracy, quality, or legality of User Content posted by users. Subject to Section 11.1, we may monitor, edit, or remove User Content at our discretion, and we do not undertake to review every submission before it is posted.

11.1 Objectionable Content and Abusive Users

BoolRider does not permit objectionable content or abusive users, and we maintain the following safeguards:

  • Filtering. Text you submit — messages, listing notes, review text, and profile fields — is screened automatically before it is posted. Content that violates Section 10 is refused at submission, and repeated attempts are escalated for review by our operations team. Photos are not screened automatically; they are reviewed when reported.
  • Reporting. Every user can report another user or their content from within the app. Reports go directly to our operations team. Report text is deliberately exempt from the content filter, so that you can quote exactly what was said to you — we will not block you from describing what happened.
  • Blocking. Every user can block another user at any time. A block is mutual in effect: blocked users cannot message you, and you will not be matched with one another.
  • Response. We review every report. Reports alleging harassment, threats, sexual misconduct, discrimination, or any risk to a person's physical safety are reviewed and acted on within 24 hours. All other reports — spam, nuisance listings, disagreements over a ride — are reviewed promptly. Action may include removing the content, restricting the account's ability to message or to post and request rides, suspending the account, or removing the user from the platform permanently.

Reports may be made in the app, or by email to support@boolrider.com. By posting User Content you agree to these terms and acknowledge that there is no tolerance for objectionable content or abusive behavior.

12. Intellectual Property

The BoolRider name, logo, branding, website, app, and all related content, features, and functionality (excluding User Content) are owned by BoolRider LLC and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of any software that comprises the Service.

13. Safety and Assumption of Risk

BoolRider is not responsible for the actions, conduct, safety, or reliability of any user. BoolRider provides a technology service that facilitates cost-shared ridesharing arrangements; it does not provide, supervise, or control transportation. By using the Service, you acknowledge and agree that:

  • Ridesharing arrangements are made between independent individuals who voluntarily choose to share a trip. BoolRider does not screen, vet, or perform background checks on users beyond verifying .edu email addresses, facilitating Stripe identity verification, and reviewing the auto-insurance document a driver submits.
  • Reviewing an insurance document means confirming that a driver supplied one and recording what it says. BoolRider does not contact insurers, confirm that a policy is in force, verify that it covers carrying passengers, or guarantee that coverage will respond to any particular incident.
  • BoolRider does not inspect vehicles, verify driving records, or guarantee that any driver or vehicle meets any particular safety standard.
  • You use the Service and participate in ridesharing arrangements at your own risk. You voluntarily assume all risks associated with using the platform and riding in or driving a vehicle with other users, including the risk of accident, injury, property damage, or death.
  • You are responsible for your own safety. BoolRider encourages all users to exercise caution, good judgment, and common sense when arranging and participating in ridesharing arrangements.

BoolRider provides in-app safety features, including user blocking, reporting, and reliability scores. These features are provided for informational purposes and user convenience. They do not constitute a guarantee of safety, nor do they create any duty or obligation on BoolRider's part to ensure user safety.

Safety features. BoolRider may offer additional in-app safety features, such as tools that help you share trip details or contact assistance in an emergency. These features are provided as aids only. They are not a substitute for contacting emergency services directly, and BoolRider does not guarantee that any message or alert sent through such features will be delivered, received, or acted upon, or that any response will occur or will occur in time. In an emergency, always call 911.

14. Limitation of Liability and Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, BoolRider disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

BoolRider does not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any content or information obtained through the Service will be accurate or reliable.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BOOLRIDER, ITS OFFICERS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOOLRIDER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO BOOLRIDER IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

15. Dispute Resolution: Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

15.1 Agreement to Arbitrate

You and BoolRider agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your relationship with BoolRider (collectively, "Disputes") will be resolved exclusively through final and binding individual arbitration, rather than in court, except as set forth below. This agreement to arbitrate is intended to be broadly interpreted.

15.2 Exceptions to Arbitration

Notwithstanding Section 15.1, either party may bring an individual action in small claims court for Disputes within the jurisdiction of such court. Either party may also seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

15.3 Arbitration Procedures

Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, which are available at www.adr.org. If AAA is unavailable, the parties will mutually agree on an alternative arbitration provider. The arbitration will be conducted in the English language. The seat of arbitration shall be Champaign County, Illinois, unless you and BoolRider agree otherwise. The arbitrator shall have exclusive authority to resolve all Disputes, including the arbitrability of any Dispute.

15.4 Class Action Waiver

YOU AND BOOLRIDER AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, and the Dispute shall proceed in court.

15.5 Opt-Out

You may opt out of this arbitration provision by sending written notice to privacy@boolrider.com within 30 days of first accepting these Terms. The notice must include your name, BoolRider account email address, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, you may pursue Disputes in court, subject to the governing law and jurisdiction provisions in Section 16.

16. Governing Law and Jurisdiction

These Terms and any Disputes not subject to arbitration shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. For any Disputes not subject to arbitration, you and BoolRider consent to the exclusive jurisdiction of the state and federal courts located in Champaign County, Illinois.

17. Indemnification

You agree to indemnify, defend, and hold harmless BoolRider and its officers, members, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your use of or access to the Service.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Your User Content.
  • Any ride in which you participate as a rider or driver.
  • Any dispute between you and another user.
  • Any claim by a third party arising from your actions or omissions in connection with the Service.

18. Modifications to the Service and Terms

Service: BoolRider reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Terms: We may revise these Terms from time to time. When we make material changes, we will notify you by updating the "Last Updated" date at the top of these Terms and by providing notice through the app or by email. Your continued use of the Service after a change constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

19. Termination

You may terminate your account at any time by using the account deletion feature in the app, subject to the conditions described in our Privacy Policy (including the requirement to resolve active bookings before deletion).

BoolRider may restrict, suspend, or terminate your account at any time, at our sole discretion, with or without cause, and with or without notice. Grounds include, but are not limited to, violation of these Terms, fraudulent or illegal activity, conduct that endangers the safety of other users, or extended inactivity.

Enforcement is graduated. We may apply a temporary restriction that leaves your account working but blocks a specific capability — messaging, or posting and requesting rides — for a set period; we may suspend an account temporarily, in which case access is restored automatically when the suspension expires; or we may ban an account permanently. Whichever applies, you may contact us at support@boolrider.com to ask us to review the decision.
